MK Party concern about SA Judges changing law to suit specific outcomes

Date: May 8, 2025

The South African (SA) opposition part uMkhonto weSizwe Party (MK) has expressed concerns about what it describes as a trend of Judges changing the law to suit a specific outcome.

The party has cited among others the ruling in the dual citizenship case which it believes was not in accordance with the country's laws.

The party has called for the implementation of lifestyle audits and mandatory asset declarations for all Judges.

It argues that judicial officers, who wield immense constitutional power must be subject to the same scrutiny as elected officials.

MK National Spokesperson, Nhlamulo Ndhlela says they aware of certain Judges who may have been influenced.

"We as parliamentarians are held accountable, for every cent, every income, and every single assert that we have. You don't even have to request it as per section 13(3), where you can avail it as in when required, no it’s there, it’s on the website.

So the reality here is that we are calling for a lifestyle audit, we are saying let that be made public and let’s see if there's any allegations that come from that. But I tell you now we are aware of certain Judges that have been influenced and that will come out."
