Bester was seeking leave to appeal against an earlier judgment by the country’s Free State High Court, dashes his hopes of challenging the alleged poor conditions of his incarceration and his plea for among things, laptop access.
The appeal relates to Bester's High Court bid to bring his legal challenge in the criminal court during pre-trial proceedings instead of the civil court as directed by the Judge President.
In a February 2025 judgment, the High Court found that the objection to the jurisdiction of the civil court was without merit and as a result, the bid did not succeed.
Bester, through his lawyers, turned to the Constitutional Court in March and argued through the founding affidavit penned by his attorney, that the High Court judgment is out of harmony with what the learned Justice was called upon to decide.
However, SA’s apex court, after considering the application, found that no case had been made out for a direct appeal.
