SA law supports Lungu family's right to choose burial location: Analyst

A legal battle over the burial of Zambia's late former President Edgar Lungu is unfolding in South Africa (SA) after the High Court in Pretoria granted an interdict halting funeral proceedings.

This comes amid tensions between Lungu’s family and the Zambian government, which insists the former leader should be buried in Zambia with full State honours.

The Pretoria High Court order followed an urgent application brought by Lungu’s family, who have refused the Zambian government’s wishes, citing the late President’s strained relationship with current Zambian leader Hakainde Hichilema. The Deputy Judge President, Aubrey Ledwaba, confirmed that all parties had agreed during consultations to delay the burial until the matter is fully heard. A new court date has been set for August 4.

Prominent human rights lawyer Advocate Simba Chitando says SA law is clear on the matter and favours the rights of the family to determine burial arrangements.

“The SA court is bound by SA law, and this is something that's probably very difficult for the Zambian government to hear,” said Chitando.

“The family have got a right to bury their loved one in a country that they wish. It would be a very different situation if the SA government had objected to the burial taking place in the country.”
