She was speaking at SA's Police and Prisons Civil rights Union’s (POPCRU) central executive committee meeting, which took place in the east of Johannesburg.
“We need to review the 1977 Criminal Procedure Act and make it make sense today because the system, the admissibility of some of the technology didn't exist in 1977. However, now there is cybercrime which requires a Criminal System Procedure Act that is embedded in the current and shows that it can exist in the future,” said Simelane.
Popcru commissioned a study into the effects of the Act ,which according to the President of the union,Thulani Ngwenya, shows gaps.
“It’s an old apartheid Criminal Procedure Act that does not resonate with the current democracy and it does not give powers clear direction in relation to operations of police. Certain sections are problematic,” explained Ngwenya.
He further explains that any legislation must have some proposal, go to the processes of parliament and open consultation. He says this law is not in the interest of politicians in parliament, they don’t take it seriously.
The five-day meeting ends today with Popcru hoping that in the year 2025 the act will be reviewed
