Thirty-seven-year-old Moroadi Cholota’s legal team has argued that the R255 million($14,36 million) asbestos corruption and fraud charges against her emerged from her refusal to comply with the State’s demand for specific testimony.
Cholota is out on bail of R2 500($140).
She was extradited from the United States earlier this month.
Legal analyst Thabo Molete says the application has a prospect of success.
“Our view, in this case, is that Moroadi Cholota might succeed in her application because our view is that the case of the State against Moroadi Cholota is not that strong and second to that for the fact that she has been given the R2 500 ($140).bail is also in my view indicative of the fact that the State does not have a good case against her.”
Molete adds: “And thirdly, the fact that the State initially started by saying we want you to be our State witness and she refused and the state suddenly changed and said because you are refusing we are charging you. So our view is that her application might be successful.”
