SA Parliament set to begin the process of removal of two judges

Date: Feb 21, 2024

South Africa's Parliament is set to begin the process today of considering the removal of two judges.

The envisaged impeachment of suspended Judge President of the Western Cape High Court John Hlophe and retired former Gauteng High Court judge division Nkola Motata emanated from the recommendations of the Judicial Service Commission (JSC). It found them guilty of gross misconduct

The JSC had found Hlope guilty of gross misconduct in 2021, for allegedly trying to influence two former justices of the Constitutional Court Bess Nkabinde and Chris Jafta in 2008, in a case involving then President of the country Jacob Zuma.

In 2018, again the JSC had found the retired Motata guilty for what the commission referred to as a dishonest defence by the judge in his response to a drunk driving and racist incident in 2007. Yesterday the Western Cape High Court undertook to announce on its formal judgment in reply on the court application by Hlophe not later than this morning.
