This is after the High Court in Pretoria struck the matter between the department and the Information Regulator off the roll saying it is not urgent.
The regulator had lodged an urgent court interdict to prevent the department from publishing the results.
According to the regulator, publishing the results would have violated the learners’ right to privacy. The court ruled otherwise.
“ The present matter of publication has been followed for at least three consecutive years, why should this year be treated differently? I therefore conclude that the matter is not urgent and should be struck off the roll. I make the following order, the matter is struck off the roll due to lack of urgency,” Judge Ronel Tolmay ruled.
