The Act, signed into law by President Cyril Ramaphosa last month, has sparked legal concerns from the opposition party, which argues that it is unconstitutional.
The DA is seeking to have the legislation nullified in its entirety. According to court papers, the party wants an order declaring the Act inconsistent with the Constitution and therefore invalid.
To support its case, the DA has raised several objections, including concerns about the constitutionality of the process through which the Act was adopted. Additionally, the party argues that the legislation is “vague and contradictory” in multiple clauses, which, in its view, makes it unconstitutional.
The legal challenge sets the stage for a significant judicial battle over the Expropriation Act, which has been a contentious issue in SA’s land reform debate.
