SA ConCourt reserves judgment on opposition party bid

The Constitutional Court in South Africa(SA) has reserved judgment in the DA bid for confirmation of the Supreme Court of Appeal (SCA) order which affirmed that any citizen who lost citizenship after acquiring another nationality remains citizen.

This follows the 2023 judgment of the SCA which upheld the Democratic Alliance's(DA) challenge of the constitutionality of a section of the Citizenship Act.

The section stipulates that South Africans may lose their citizenship upon voluntary and formal acquisition of citizenship of another country.

The apex court heard submissions from the DA which sought the final affirmation on the 2023 SCA order which found that the said section arbitrarily imposes a loss of citizenship on those who acquire a second citizenship, while failing to advance any legitimate government purpose.

Advocate Anton Katz SC on behalf of the DA presented the party's arguments, "We submit that the supreme court of appeal got it bang on correctly by finding that not only did the respondents not put up any rationale for the purpose of 6(1)a but there is no purpose objectively."
