SA ConCourt scraps law stripping of citizenship for acquiring another nationality

South Africa's (SA) Constitutional Court (ConCourt) has ruled to scrap Section 6(1) of the SA Citizenship Act of 1995.

This section stipulates that SA automatically lose their citizenship if they voluntarily acquire another nationality, unless they apply for and receive prior retention of citizenship from the Minister of Home Affairs.

Delivering the ruling, Justice Steven Majiedt declared that the section is unconstitutional and must be scrapped with retrospective effect from the date of its promulgation, October 6 1995.

The Supreme Court of Appeal had previously found the section to be unconstitutional, but the ConCourt’s ratification was required to finalise the decision.
