Referendum required for Zimbabwean President term extension: Lawyer

A referendum would be necessary to allow Zimbabwean President Emmerson Mnangagwa to extend his term of office, according to human rights lawyer and activist Doug Coltart.

This follows confirmation from a ZANU-PF parliamentarian that the ruling party, along with a faction of the opposition Citizens Coalition for Change, plans to amend the Zimbabwe Constitution to extend the President's term beyond 2028 when his two terms expire.

Proponents of the draft motion argue that Mnangagwa deserves an extension of his term. However, Coltart emphasizes that the law stipulates any change in legislation should not benefit the incumbent.

"At this stage, all we have is a draft motion from ZANU-PF. A bill would need to be introduced to parliament, go for public consultation, and be passed by a two-thirds majority in both houses of parliament. Because they are seeking to make this extension of the term of office apply to the incumbent, we have a special provision in our Constitution which says changes in terms of office should not benefit the incumbent. So what they want to do is repeal that provision, which requires the Constitutional amendment to go for a referendum," Coltart explains.
