SA Justice Minister calls for accountability following Omotoso acquittal

South Africa’s (SA) Minister of Justice and Constitutional Development, Mmamoloko Kubayi, has voiced her deep concern over the handling of the high-profile Timothy Omotoso case.

This follows the Gqeberha High Court’s decision to acquit Omotoso and his co-accused of all charges, including rape, sexual assault, and human trafficking.

In response to the controversial ruling, Kubayi has formally requested a comprehensive report from the National Director of Public Prosecutions.

This request, made under section 33(a) of the National Prosecuting Authority Act, aims to uncover the factors that led to the case’s outcome. The Minister’s call underscores the importance of accountability and transparency within the justice system, particularly in cases of such gravity.

Reflecting on the judgment, Kubayi expressed her personal anguish and commitment to addressing the matter. “Listening to the judge was the most painful thing for me as the Minister overseeing this portfolio. I can’t avert responsibility, I cannot shield myself from taking accountability and being accountable to South African society, especially listening to that judgment,” she stated.

Kubayi emphasised the need for introspection and reform within the justice system to restore public confidence.

“It’s a moment for all of us in this portfolio to reflect and ask what we are going to do better to rebuild the confidence of South Africans in the justice system of this country. And that starts with me,” she added.

The Minister assured the public that she would address the matter further once the requested report is received. Her remarks highlight the urgency of ensuring that cases are handled effectively and efficiently to deliver justice for all parties involved.
