SA Whistleblower Protection Bill, a step towards justice

The recent burial of crime activist and whistleblower Pamela Mabini has reignited urgent calls to address the vulnerabilities faced by whistle-blowers in South Africa (SA).

Mabini was shot and killed earlier this month. 

Amidst growing concerns over inadequate protective measures, President Cyril Ramaphosa has announced plans to finalise a comprehensive whistleblower protection framework through the Whistleblower Protection Bill.
Sentebale Makara, Director for Dispute Resolution at the law firm Cliffe Dekker Hofmeyr, has lauded the proposed legislation as a significant advancement.

"There's no system that's foolproof, but certainly a step in the right direction," Makara stated.

He highlighted that the Bill addresses critical gaps in the existing Protected Disclosures Act, which is limited to employer-employee relationships and excludes independent contractors.

Makara also pointed out the Bill's innovative features, including an incentive mechanism and provisions to extend protection to whistle-blowers' family members. "It starts contemplating and considering family members and your extended family as well, creating a safety net for them," he explained.
