In April, Judge Irma Schoeman ruled that the state had not proven beyond reasonable doubt that the three had committed crimes related to human trafficking and rape.
National Prosecuting Authority (NPA) Spokesperson, Mthunzi Mhaga, says the state has submitted a request for clarification of the judge’s factual findings.
“This is the only limited mechanism in which the state can appeal an acquittal judgment in SA law,” said Mhaga. “We take the view that it will be appropriate and in order for the Honourable Judge to provide such clarification before the state can identify and request her to reserve those questions of law.”
