SA court to rule on request for clarification on Omotoso acquittal

South African (SA) Judge Irma Schoeman was on Tuesday expected to deliver her judgment in the application by the state for clarification on the acquittal of Nigerian televangelist, Timothy Omotoso

The court will deliver the judgement on the case against Omotoso and his co-accused, Lusanda Sulani and Zukiswa Sitho.

This after SA’s National Prosecuting Authority (NPA) sent a request for clarification of factual findings in Schoeman’s judgment after she found Omotoso and her co-accused not guilty on charges of racketeering, human trafficking and rape in April.

She ruled that the state failed to prove the case beyond a reasonable doubt, claiming that there was not enough evidence provided and poor cross-examination by the state.

On Monday last week, this matter was heard in the Gqeberha High Court in the Eastern Cape Province, where the state and defence were required to argue the matter.

The application is the first step of the National Prosecuting Authority towards appealing the judgment.

Timothy Omotoso’s lawyer, Peter Daubermann, was against the application, claiming that this was vague and an abuse of the court process.
