The private prosecution, which was invalidated in July 2023, has been on the court's roll pending appeals. The latest appeal at the Constitutional Court was refused with the court finding "no reasonable prospects of success on the merits".

Zuma sought  to privately prosecute the incumbent over the alleged leak of his health records in his corruption trial before the KZN High Court in Pietermaritzburg.

Zuma accused his successor of being an accessory after the fact in the alleged leak.  The former President's latest failure to revive the private prosecution bid may bring this chapter to a close as the matter is likely to be removed from the criminal court roll on Thursday ( February 6, 2025).
