The court ruled that the matter lacked urgency. The Regulator had argued that publishing the results breaches privacy laws.
The Department and AfriForum opposed the application, citing a 2022 ruling that deemed the publication of the results to be in the public interest.
Information Regulator’s spokesperson Mukelani Dimba says their concerns remain valid.
“So, it is struck off the urgent roll. The matter will still be heard in normal court. So, of course, we are disappointed as the Information Regulator that the court found that there was no urgency in our application. However, the issues that we brought to this court, they still stand.”
