The DA which is the applicant in the matter, has argued that government's Employment Equity Act is unfair and unconstitutional.
Under the Act, private companies will be forced to comply with employment laws when hiring South Africans or risk a penalty.
But Jamie argued that while the quotas set out by government must be achieved within a five year period by private companies, government does not set out how it should be done.
"Now these targets, in terms of this document, my lady, must be hit within five years. It's not explained how and how incremental that has to be. It's not explained what target you have to reach in year one, year two, et cetera. That would be a separate round. It is a separate basis for attack because it is vague, my lady, but that is not an attack we've taken," said.
