Omotoso was arrested on Saturday in East London and appeared in the East London Regional Court on charges related to contravening the Immigration Act.

According to National Prosecuting Authority (NPA) Spokesperson Luxolo Tyali, the court ordered his release because the Department of Home Affairs failed to follow proper procedures. “He was supposed to be brought to court within 48 hours,” said Tyali.

Omotoso has since filed an urgent High Court application to challenge his prohibited status in South Africa.
