Magudumana is seeking a declaration order from the Supreme Court of Appeal that her arrest was unlawful.

Advocate Katz questioned on what basis the police and the Home Affairs Department officials travelled to Tanzania if they were not there to arrest her.

He contended that police power ends at the border, so they had no business being in Tanzania in April 2023.

Katz emphasised that if Magudumana was deported, there wouldn’t be a need for the two countries to have an agreement, instead Tanzania would have just deported her.
