SA enhances digital forensics to combat financial crime

Date: Dec 12, 2024

In a groundbreaking move to bolster the fight against financial crimes, South Africa's (SA) Directorate for Priority Crime Investigation (Hawks) has launched the Section 205 digital subpoena initiative.

This new development allows law enforcement agencies to subpoena bank records digitally, significantly speeding up the process and aligning the country with global standards in digital law enforcement.

The initiative, unveiled by Hawks National Head Lieutenant General Godfrey Lebeya, is part of a broader effort to improve the investigation and prosecution of serious financial crimes, including money laundering. Speaking at the launch, Lebeya emphasised the crucial role of digital forensics in tackling corruption, organised crime, and other major offences, noting that collaboration between government and business is essential for effective law enforcement.

This development follows the establishment of the Digital and Financial Forensic Centre, a joint venture between the Hawks, the Banking Association of SA and the South African Banking Risk Information Centre (SABRIC). The centre aims to enhance the capacity of law enforcement and support efforts to address South Africa’s financial crime challenges.

Nischal Mewalall, Chief Executive Officer of SABRIC, highlighted that the new system will also help SA maintain its international financial standing by improving its response to money laundering.

The project reflects a united effort to strengthen the criminal justice system and uphold high ethical standards in digital investigations.
