The development follows continued engagements between the Commission and the merging parties. The Tribunal had initially rejected the deal, citing concerns over reduced competition, overlapping infrastructure, and the risk of price hikes.
According to Competition Commission Spokesperson Siyabulela Makhunga, the revised conditions have now been restructured and will be presented to the Competition Appeal Court.
“These conditions have since been reconfigured by the parties and are now a subject of consideration by the Competition Appeal Court, which means that the Commission would now go to the Commission’s Appeal Court not to oppose the appeal applications by the merging parties as well as the Minister of Trade, Industry and Competition,” Makhunga said.
The matter is now set to proceed on an unopposed basis before the Competition Appeal Court.
